QUESTIONS
Q: What are the mediator's qualifications?

A:  As a Florida Supreme Court Certified Family Mediator Ms. Durnell has been
through a rigorous two-part training program that contained both classroom and
real-world training. Certified mediators are bound by ethical  and procedural rules of
conduct and are required to participate in additional training every two years in order
to keep their certification current. As is quite common among family mediators, Ms.
Durnell is also a lawyer.

Q:  If the mediator is also a lawyer, why can't she give one or both of us legal advice?

A: The role of a mediator is very different from the role of a lawyer. A mediator has to
remain neutral and  be not partial to one side or the other. Therefore, a mediator
can use their knowledge to assist parties during the mediation but cannot give legal
advice.  However, both parties are encouraged to have an attorney of their choice
look over the mediation agreement before they sign it.
Q: Will the mediator prepare the court documents needed to file our divorce?

A: No. The mediator will prepare a mediation agreement which lists all of the items
you have agreed upon. The mediation agreement will contain much of the
information needed to file the court documents.  Many of the necessary divorce
forms have been simplified and designed to be filled out by non-lawyers. You can
obtain divorce forms for free on the internet or for a nominal fee at the Orange
County courthouse.

Q: How many mediation sessions will we need to attend?

A: It depends on the amount of issues you wish to discuss as well are how  willing
you and your spouse are to come to an agreement. Also, if you own a business or
are deciding the living arrangements of children, you should expect to attend more
sessions than someone who does not.
